The Unconstitutional United States Supreme Court

The Supreme court was created to make sure that everyone, including the President, Congress, and all citizens follow the Constitution.

They were to be the arbiters of what is “Constitutional” or what is “Unconstitutional”.

Instead, the Supreme Court is now a hotbed of political partisanship and worries about whether a law or executive order will “affect” our American citizens or, whether if , as Ruth Bader Ginsberg is quoted as saying,  “….the American people are ‘ready” for gay marriage”.

How far the Justices have come from the ideal of judging laws and issues, based on the simple criteria that the law or issue be consistent with the Constitution of the United States!

Now, Chief Justice Roberts worries about whether the court will be seen as partisan.

Ginsberg believes a law should stand because she perceives that the public is ready for it.

Kennedy worries about the impact of rejecting a law because of its impact upon health insurance companies!

While the decision as to whether some law is truly Constitutional might be difficult, that is the ONLY basis for either accepting or rejecting a new law.

So, Roberts and Ginsberg and Kennedy, please remember that you are to see if every new law reflects the intent of the Constitution.  Other factors, such as whether new laws have an economic or emotional impact upon Americans was NEVER to be the criteria upon which laws are judged!

YOU ARE ARBITERS OF THE CONSTITUTION.  YOU ARE NOT THE CONSCIENCE OF AMERICA. 

Who is this guy, Obama?

President Obama is supposedly a wildly intelligent man, well versed in the Constitution of the United States.  After all, he was a Professor of Constitutional Law.

However, in his latest attempt to be Ruler of the Universe,  he states that the Supreme Court has NO RIGHT to overturn Obamacare because they are unelected!

Not only is he obviously wrong, it shows he is willing to say anything or do anything, even if it divides our country, in order to stay in office.  When he was sworn into office, he promised to uphold the Constitution of the United States.  But, has he?  If actions speak louder than words, President Obama has done everything in his power to thwart the legitimate actions of the separate, but co-equal branches of Government.

He has forgotten the very framework of our country is founded on the concept that the Supreme Court is an equal, but independent body from the Presidency and the Congress.

He has forgotten that the Supreme Court justices are appointed by the President, confirmed by Congress, and stay in office for life.

He has forgotten that the sole purpose of the Supreme Court is to study the constitutionality of any and all laws.

His charge that the Supreme Court has no right to overturn ANY law is such a bare faced lie that you wonder how he can say it with a straight face.  Of course they can overturn anything Congress passes!  After all, that’s THEIR JOB!

My gosh, where has this guy been?  It’s almost as if he’s spent his entire Presidential term out on the golf course!

Now, THAT’S the spirit………of the law!

Bad news for Obama: Conservative Justice Kennedy tells pals he’s in no rush to leave Supreme Court

WASHINGTON – President Obama may get liberal Elena Kagan on the Supreme Court, but conservative swing-voter Anthony Kennedy says he’s not going anywhere anytime soon.

Justice Kennedy, who turns 74 this month, has told relatives and friends he plans to stay on the high court for at least three more years – through the end of Obama’s first term, sources said.

That means Kennedy will be around to provide a fifth vote for the court’s conservative bloc through the 2012 presidential election. If Obama loses, Kennedy could retire and expect a Republican President to choose a conservative justice.

Kennedy, appointed by President Ronald Reagan, has been on the court 22 years. He has become a bit of a political nemesis at the White House for his increasing tendency to side with the court’s four rock-ribbed conservative justices.

Without naming Kennedy, Obama was unusually critical of his majority opinion in the Citizens United case, handed down last January. That 5-4 decision struck down limits on contributions to political campaigns as an abridgement of free speech.

Every court case is based on the law.  Unfortunately, Obama considers himself and his philosophy ABOVE the law.  Justice Kennedy might be the best hope of our country to remain the country that we all know and love.  I applaud his determination to support the traditional interpretation of the Constitution rather than let Lieberals alter the very foundation of our country’s law.

Now, THAT’s the spirit, Justice Kennedy, of the law.
